Complete Training (Devon) LTD – Terms and Conditions

1. About these Terms

These Terms and Conditions govern the purchase, enrolment, access and delivery of training and related services supplied by Complete Training (Devon) LTD, trading as Complete Training (“Complete Training”, “CT”, “we”, “us” or “our”).

They apply to individual learners, employers, organisations, sponsors and other clients purchasing or commissioning training from us. They should be read alongside the relevant course page, quotation, booking confirmation, programme agreement, funding agreement, learner handbook, awarding body requirements and any service specific terms identified at the time of purchase.

Where a separate written agreement expressly states that one of its provisions takes precedence over these Terms, that provision will apply to the extent of the conflict.

3. Contract formation and course information

A Course advertised on our website is an invitation to purchase. Where a purchase is made through our website, the Learner or purchaser is making an offer to purchase the Course on these Terms. A contract is formed when Complete Training accepts the order, including by issuing an order confirmation, confirming enrolment, providing access to the Course or otherwise confirming that the training will be supplied. Payment being taken or authorised does not, by itself, require Complete Training to accept an order where the order cannot lawfully or reasonably be fulfilled.

By completing a purchase through our website, the purchaser confirms that they have had the opportunity to review and agree to these Terms and any course-specific terms presented as part of the purchase.

Course descriptions, dates, duration, delivery method, entry requirements, access periods, assessment arrangements and included fees may vary between Courses. The information stated on the relevant course page, quotation or programme agreement forms part of the contract.

The person making a purchase on behalf of an organisation confirms that they have authority to commit that organisation to the purchase.

Complete Training may refuse an application or enrolment where eligibility requirements are not met, capacity is unavailable, required information has not been supplied, or there is another reasonable operational, safeguarding, funding or professional reason.

Complete Training may use an initial assessment, skills check, eligibility review or discussion to establish whether a Course or qualification level is suitable for a Learner. Where appropriate, Complete Training may recommend a different level, route or start date.

Completion of one Complete Training Course or qualification does not automatically guarantee admission or progression to a higher level. Entry to a subsequent Course may depend on qualification results, demonstrated skills, assessment, eligibility, capacity or other published entry requirements.

Some Courses are accelerated or intensive. An advertised teaching period does not reduce the learning, practice, assessment or qualification requirements that apply. Learners may need to complete substantial independent study and practice outside scheduled teaching.

4. Individual and Group purchases

4.1 Individual purchases

An Individual Purchase provides access for one Learner only. Login details, course access and Course Materials must not be shared with another person unless Complete Training has expressly agreed otherwise in writing.

4.2 Group purchases

Employers, organisations and other Clients may purchase multiple Seats using the Group function on the Complete Training website. The Client selects the number of Seats required and can complete checkout without providing individual Learner details.

A Group is created automatically, and the purchasing user will normally become the Group Leader. The Group Leader may invite Learners later and add or manage Learners through the dashboard where that functionality is available.

The Group Leader may purchase additional Seats for the Group through their account on the Complete Training website where this functionality is available. Additional Seats will be charged at the price displayed at the time of purchase and, once purchased, may be allocated to Learners through the Group dashboard.

Each Seat is for one Learner and must not be shared between multiple people. A Seat may be reassigned to another Learner before the Course has been started, subject to Complete Training approval where required. Once a Learner has started the Course or accessed any Course content, the Seat is assigned to that Learner and cannot be transferred or reassigned to another person.

The Group Leader is responsible for allocating Seats appropriately, maintaining the security of Group administration access and ensuring invited Learners are made aware of the conditions applicable to their Course.

Group functionality does not give a Group Leader ownership of a Learner’s personal account or unrestricted access to personal information. Progress, completion and other information will only be made available where appropriate and in accordance with applicable privacy and data protection requirements.

Unused Seats remain subject to any validity or expiry period stated at purchase. Additional Seats, extensions or approved transfers may be charged at the rate applicable at the time.

Where the purchasing organisation needs to change its Group Leader, Complete Training may transfer Group administration rights following a request from an appropriately authorised representative of that organisation.

Removing a Learner from a Group does not automatically delete the Learner’s learning, assessment or audit record. Complete Training may retain records where required for contractual, regulatory, Awarding Body, funding, safeguarding or legal purposes.

A Group Leader cannot alter assessment outcomes, attendance records or evidence held by Complete Training. If a Learner leaves the purchasing organisation after a Seat has been activated or the Learner has accessed any Course content, the Seat will not become available for transfer or reassignment to another Learner.

5. Token purchases

Where Complete Training offers Tokens, Tokens may be purchased in bulk for specified Courses or bundles. Each Token normally represents one individual Course access and is valid only for the Course or bundle identified at purchase.

The purchaser is responsible for distributing Token codes securely. A Token must be redeemed in accordance with the instructions provided and may not be duplicated, resold or used more times than permitted.

Tokens are valid for the period stated at purchase. Expired Tokens will not normally be honoured unless Complete Training agrees otherwise. Misuse may result in suspension or cancellation of the affected code or access.

Tokens and Group Seats are separate purchasing methods. The conditions displayed at purchase will identify which method applies.

6. Fees, VAT and payment

Course fees are those stated on the website, quotation, invoice or programme agreement at the time of purchase. VAT will be applied where legally applicable.

Payment may be made using the methods offered by Complete Training at checkout or agreed in writing. Where instalments or a payment plan are agreed, payments remain due on the agreed dates irrespective of the speed at which the Learner progresses through the Course.

If a payment is missed or declined, Complete Training may contact the Client or Learner and may temporarily suspend access while the account is brought up to date, subject to applicable consumer law and any funding requirements.

Where a qualification, examination or registration fee is included in the advertised Course price, this will be stated in the Course information. Resits, replacement certificates, late changes, additional assessment attempts or other additional services may be separately chargeable.

Where lawfully permitted, Complete Training may withhold a certificate of completion issued by Complete Training while sums properly due under the relevant contract remain unpaid. Complete Training cannot control the issue of certificates by an external Awarding Body.

7. Consumer cancellation rights

Nothing in these Terms removes or restricts statutory consumer rights.

Where a Client purchases as a consumer at a distance or away from Complete Training’s business premises and statutory cancellation rights apply, the consumer will normally have 14 days from conclusion of the contract to cancel without giving a reason.

Where the consumer expressly asks Complete Training to begin a service during the statutory cancellation period, the consumer may be required to pay for the proportion of the service supplied before cancellation, where the law permits.

Where digital content is supplied immediately, Complete Training may ask the consumer to expressly consent to immediate supply and acknowledge that the statutory right to cancel will be lost once supply begins, where the applicable law allows this.

Cancellation can be communicated clearly to Complete Training using the contact details in these Terms. Any additional course specific cancellation, withdrawal or refund conditions apply only to the extent that they are consistent with statutory rights.

8. Withdrawal, transfers and deferrals

Outside any statutory cancellation right, withdrawal, refund, transfer and deferral requests will be dealt with in accordance with the relevant Course or programme conditions and any written agreement made at enrolment.

Complete Training retains discretion to approve a transfer between Courses or, where appropriate, a transfer to another person before access has been used or external registration has taken place. We will consider reasonable and compassionate requests.

Where Complete Training approves a transfer to another Course, fees already paid may be credited against the replacement Course. If the replacement Course costs more, the balance is payable. Unless otherwise stated or waived by CT, an approved course transfer is subject to a £40 administration fee.

External registration, assessment or Awarding Body fees already incurred may be non-refundable and may need to be paid again following a transfer or deferral.

Funded Programmes may have separate withdrawal, transfer and deferral rules imposed by the funder or commissioner.

9. Course access, expiry and extensions

Unless otherwise stated on the Course page, booking confirmation or programme agreement, access to a self-directed online Course will normally be provided for 90 days from activation. Certain accredited, funded or specialist Courses have different access periods.

Some Courses must be completed within a specified timeframe because of assessment, funding, Awarding Body, cohort or delivery requirements.

Where an online Course expires, the Learner should request an extension within three weeks of expiry. If no extension is requested, Complete Training may remove the Learner from the Course and may delete or archive associated submissions in accordance with our retention arrangements.

Where the existing extension scheme applies, expired online access is charged at £30 including VAT per month from the date of expiry. Complete Training may change extension pricing for future purchases by displaying the applicable price before the extension is purchased.

Where a Learner takes a break of six months or more and later asks to reactivate a Course, a £40 reactivation fee may apply unless a different Course or programme condition applies.

An extension does not automatically extend Awarding Body registration, examination deadlines, funding eligibility or any externally imposed completion date.

10. Delivery methods and changes

Courses may be delivered face to face, live online, self-directed online or through a blended model. The delivery method will be stated in the relevant Course information.

Complete Training may make reasonable changes to timetables, rooms, teachers, delivery platforms or delivery methods where necessary. Where a material change is required, Complete Training will provide reasonable notice where practicable and seek to minimise disruption.

Complete Training may substitute a suitably qualified or experienced teacher or trainer. Enrolment does not give a Learner a contractual right to be taught by a particular individual unless expressly agreed.

Complete Training may update Course Materials to maintain accuracy, quality, accessibility or relevance, provided that the overall Course remains materially consistent with what was purchased.

For cohort-based Courses, Complete Training may set minimum learner numbers. If a cohort is not viable, Complete Training may postpone a start date, merge cohorts, change the timetable or offer an alternative delivery arrangement. Complete Training will provide reasonable notice where practicable and will consider appropriate options for a paying Client where a material revised arrangement is unsuitable.

Complete Training may correct, update or replace Course Materials to reflect changes in law, good practice, language use, technology, Awarding Body requirements or identified errors, provided that the overall learning purpose is not materially reduced.

British Sign Language is a living language and may include regional, generational and individual variation. Learners may encounter different legitimate signs, expressions and language choices during training. Variation from a sign previously learned does not necessarily mean that either form is incorrect.

Courses may include guest speakers, assessors, specialist contributors or other appropriately selected professionals. Marketing about Complete Training’s teaching team does not create a contractual entitlement to every element of a Course being delivered by one named teacher or category of teacher.

11. Attendance, participation and engagement

Learners are expected to attend, participate and complete required learning activities, tutorials, independent study, assignments, practice, mock assessments and examinations appropriate to their Course.

Learners should arrive or join sessions on time and notify Complete Training as soon as reasonably possible if they cannot attend.

Poor attendance or engagement may affect progress, readiness for assessment and the ability to complete a Course. For accredited or Funded Programmes, Complete Training may be required to withdraw a Learner who does not meet applicable participation or evidence requirements.

Where minimum guided learning, attendance or participation requirements apply, they will be explained through the Course, learner information or programme agreement.

Where visual participation is necessary for BSL teaching, practice or assessment, Learners may be required to use suitable camera positioning, lighting and visibility during live online sessions. Complete Training will consider reasonable adjustments where these requirements create an accessibility barrier.

Learners should use Complete Training’s official communication channels for course administration, assessment queries and support. Teachers are not required to provide private tuition, course administration or assessment support through personal telephone numbers, messaging accounts or social media.

For face-to-face delivery, Learners must follow reasonable venue, health and safety, evacuation and access instructions and take reasonable care of Complete Training, venue and third party property. Learners remain responsible for their personal belongings.

12. Submissions, marking and feedback

Where assessment is automated through the learning platform, results or feedback may be provided immediately.

Where work is reviewed manually, submissions must be made through the method specified by Complete Training. Unless Complete Training states otherwise, email submissions will not be accepted where the Course requires submission through the learning platform.

Complete Training normally allows up to seven Business Days for manually reviewed work to be marked and returned. Complex assessments, moderation, internal quality assurance, staff absence or Awarding Body processes may require additional time.

Learners should avoid submitting duplicate copies or repeatedly chasing work during the stated marking period, as this can create administrative delay.

Feedback is intended to support learning and does not guarantee that a subsequent assessment will be passed.

13. Accredited qualifications and Awarding Bodies

Where a Course leads to an externally regulated or awarded qualification, the Learner must comply with the rules of the relevant Awarding Body as well as these Terms.

The timescales for assessment results and the issue of qualification certificates are determined wholly or partly by the relevant Awarding Body and may vary significantly between qualifications and Awarding Bodies. Results and certificates may take a significant period of time to be issued following completion of training or assessment. Complete Training cannot guarantee a specific timescale for results or certification where these are dependent on an Awarding Body or another external organisation.

Charges may apply for the issue, reissue, replacement or postage of certificates. Where a Learner requests a physical certificate to be posted, including where postage or delivery is not included within the Course fee, the applicable charge must be paid before the certificate is dispatched. Any applicable certificate or postage charges will be confirmed by Complete Training or displayed on our website.

Complete Training may be required to register Learners, verify identity, retain assessment evidence, conduct internal quality assurance, arrange external quality assurance and provide information to the Awarding Body.

Assessment dates, formats, evidence requirements, permitted adjustments, resit rules and certification may be controlled wholly or partly by the Awarding Body. Complete Training cannot override an Awarding Body decision.

Complete Training will deliver training and assessment with reasonable care and skill but does not guarantee that a Learner will pass an examination, assessment or qualification.

A Complete Training certificate of attendance or completion is distinct from an externally awarded qualification certificate unless expressly stated otherwise. Completion of teaching or assessment does not mean that an externally awarded certificate will be immediately available.

14. Examinations, assessments and resits

Learners are responsible for attending booked examinations or assessments and complying with identification, conduct and evidence requirements.

Where an examination or assessment fee is included in the Course fee, this will be stated in the Course information. Resits, replacement assessments, late entry fees or changes requested by the Learner may incur additional charges.

A Learner who is not ready for assessment may be advised to undertake further learning or practice before an assessment is booked. Any decision to defer an assessment will take account of Awarding Body and funding rules.

Assessment malpractice, impersonation, unauthorised assistance, falsification of evidence or other academic misconduct may be investigated and reported to the relevant Awarding Body where required.

Complete Training may advise that a Learner is not yet ready for an examination or assessment. Complete Training is not required to enter a Learner for an assessment where doing so would conflict with Awarding Body requirements, qualification standards, funding requirements or Complete Training’s assessment responsibilities.

Where a Learner cancels, misses or fails to attend a booked examination or assessment, any fee already incurred by Complete Training may remain payable and a further fee may apply to rearrange the assessment, subject to the relevant Course, Awarding Body rules and statutory rights.

Awarding Bodies may change specifications, assessment methods, fees, evidence requirements, qualification availability or administrative processes. Complete Training may make corresponding reasonable changes to Course delivery or assessment arrangements where necessary.

Completion of teaching or assessment with Complete Training does not guarantee immediate issue of an external certificate. External verification, quality assurance and certificate processing times are controlled by the relevant Awarding Body.

15. Learner evidence and integrity

Learners must ensure that information, evidence, attendance records, assessment submissions and declarations provided to Complete Training are accurate and genuinely relate to them.

A Learner must not ask another person to complete an assessment on their behalf, submit another person’s work as their own, falsify attendance or evidence, receive unauthorised assistance during an assessment, manipulate recorded assessment evidence or knowingly provide false information relating to eligibility, employment, progression, outcomes or funding.

Where Complete Training reasonably suspects malpractice, fraud or inaccurate evidence, it may pause assessment, certification, funding claims or Course participation while the matter is reviewed. Complete Training may be required to report relevant matters to an Awarding Body, funder, commissioner or other appropriate organisation.

Nothing in this section prevents a Learner from receiving an agreed reasonable adjustment or authorised support.

16. Appeals, complaints and academic decisions

Learners may appeal an assessment decision where they believe the decision or assessment process was incorrect. Appeals must follow CT’s current Appeals Policy and, where applicable, the Awarding Body’s procedure and deadlines.

Where an internal appeal is available, the assessment and relevant evidence will be reviewed by an appropriately authorised person who was not solely responsible for the original decision wherever practicable.

A further external appeal may be available through the relevant Awarding Body where its rules permit.

Complaints about service, administration, teaching or another aspect of Complete Training should be raised through CT’s Complaints Procedure. Making a complaint or appeal in good faith will not disadvantage a Learner, with further information available in our complaints policy: https://completetrainingltd.co.uk/complaints/

17. Reasonable adjustments and accessibility

Complete Training aims to provide accessible and inclusive training. Learners are encouraged to tell us as early as possible about reasonable adjustments or access requirements that may affect participation, assessment or use of the learning platform.

Complete Training will consider reasonable adjustments in accordance with applicable law and the requirements of the Course. For externally assessed qualifications, some adjustments may require evidence, advance application or approval from the Awarding Body.

Complete Training cannot change the competence standard or assessment requirement of an external qualification where it does not have authority to do so, but will work with the Learner and Awarding Body to identify permitted adjustments. Requested adjustments cannot be guaranteed and may not be permitted under the relevant Awarding Body’s rules.

Where a digital process creates an accessibility barrier, Learners should contact Complete Training so that an appropriate alternative can be considered, where reasonably practicable.

18. Learner conduct, safety and safeguarding

Learners, Clients and Group Leaders must communicate with Complete Training staff, teachers and other Learners appropriately. Complete Training will not tolerate threatening, abusive, discriminatory, harassing or intimidating behaviour.

Reasonable disagreement, feedback, complaints and appeals are not misconduct merely because they challenge Complete Training or an assessment decision.

Complete Training may take proportionate action where conduct disrupts learning, creates a safeguarding or safety concern, affects other Learners, or places staff at unreasonable risk. This may include warnings, conditions on participation, temporary suspension or removal from a Course.

Where safeguarding concerns arise, Complete Training may act in accordance with its safeguarding procedures and may share information where necessary and lawful to protect a child or adult at risk.

19. Intellectual property, recording and AI

All intellectual property rights in Complete Training Course Materials are owned by or licensed to Complete Training unless stated otherwise. Purchasing a Course gives the Learner a limited, personal, non-transferable right to use the materials for their own learning.

Course Materials must not be copied, republished, sold, uploaded, adapted, distributed or used to create competing training without Complete Training’s prior written permission, except where permitted by law.

Learners must not record face to face or live online teaching, teachers or other Learners without prior permission. This includes screenshots, screen recording, audio recording and filming.

Complete Training Course Materials, teaching recordings, assessment content and other protected materials must not be uploaded to generative AI systems, datasets, automated training tools or other third party systems for model training, reproduction or redistribution without Complete Training’s written permission.

Learners must comply with Complete Training’s current AI and academic integrity requirements when preparing assessed work. Where AI use is permitted, the Learner remains responsible for the accuracy, originality and integrity of the work submitted.

Where Complete Training proposes to record a teaching session for quality assurance, learning or another legitimate purpose, Complete Training will provide appropriate information and obtain consent where consent is required. Learners must not assume that participation gives them a right to receive or reuse any recording.

Where a Learner creates or submits video, audio, written or other evidence for assessment, the Learner retains ownership of their original content, subject to granting CT and, where relevant, the Awarding Body, internal quality assurer, external quality assurer, funder or regulator the rights reasonably necessary to receive, store, review, moderate and quality assure that evidence.

Learners must respect the privacy and confidentiality of other Learners, staff and third parties discussed during training. Identifiable information about service users, colleagues, Deaf people or other individuals should not be shared in learning activities unless it is appropriate and lawful to do so.

Learners must not publish screenshots, recordings, private classroom discussions or identifiable information about other Learners or staff on social media or other public platforms without appropriate permission.

20. Online platform and technology

Learners are responsible for having a suitable device, internet connection, browser and any other basic technology identified for the Course.

For remote one-to-one tuition, mentoring, assessments or other live online sessions, the Learner is responsible for ensuring that they have a suitable device, stable internet connection and any other technology reasonably required to participate in the session. Learners should ensure that their equipment and connection are working before the scheduled start time.

Where a remote session is delayed, interrupted or cannot continue because of the Learner’s internet connection, equipment, software or another technical issue on their side, the booked session will remain chargeable and will normally end at the originally scheduled time. Complete Training is not required to extend, rearrange or refund the session as a result of such issues.

Where a session cannot proceed because of a technical failure attributable to Complete Training, we will take reasonable steps to rearrange the affected time or provide an appropriate alternative.

Where a Learner joins a one-to-one session late, the session will still finish at the originally scheduled time and the full booked session will remain chargeable.

Account credentials must be kept secure and must not be shared. Complete Training may suspend access where it reasonably believes an account has been compromised or misused.

Complete Training will use reasonable efforts to keep its learning systems available but cannot guarantee uninterrupted access. Planned maintenance, third party outages, internet failures, cyber incidents or other events outside Complete Training’s reasonable control may temporarily affect availability.

Where a material platform failure prevents learning for a significant period, CT will take reasonable steps to restore access or provide an appropriate alternative or extension.

21. Skills Bootcamps and other Funded Programmes

A Funded Programme is subject to the eligibility, evidence, attendance, participation, outcome and reporting requirements imposed by the relevant funder, commissioner or contract in force for that programme.

Learners and, where applicable, Employers must provide accurate information and evidence reasonably required to establish eligibility and support funding claims. This may include identity, residency, employment, prior learning, attendance, progression and outcome information.

Complete Training may be required to collect and report information to a public authority, commissioner or funding body. Relevant privacy information will explain how personal data is used.

Eligibility for a funded place is not guaranteed until Complete Training has completed the required checks and confirmed the place.

If eligibility changes, required evidence is not supplied, information is materially inaccurate, or the Learner ceases to meet programme requirements, Complete Training may be required to withdraw the Learner or amend the funding arrangement.

No Learner or Employer will automatically become personally liable for lost public funding solely because funding cannot be claimed. Any employer contribution, learner charge or recovery of costs must be permitted by the relevant funding rules and agreed contractual arrangements.

Specific programme rules, including employer contributions, milestones, completion requirements and progression or outcome evidence, may be set out in a separate programme agreement and will take precedence where expressly stated.

Learners and Employers must respond to reasonable post-course requests for progression and outcome evidence where Complete Training is contractually required to evidence programme outcomes. This obligation may continue for the period specified by the applicable funding or commissioning rules after training has ended.

Learners, Employers and Group Leaders must not ask Complete Training to record attendance, employment, progression or outcome information that Complete Training knows to be inaccurate. Complete Training may refuse, correct or report inaccurate evidence where required by the relevant funding arrangement.

Skills Bootcamps and other Funded Programmes are supported by public funding and are subject to the eligibility, evidence, attendance, participation, completion, progression, outcome and reporting requirements imposed by the relevant government department, Funding Body, commissioner, Contracting Authority or programme contract in force at the relevant time.

Where Complete Training delivers a Skills Bootcamp through a local authority or other commissioning body, including Devon County Council’s Train4Tomorrow programme where applicable, the Learner and Employer acknowledge that Complete Training must comply with the requirements of that programme and the applicable funding and commissioning arrangements.

21.1 Eligibility and evidence

Eligibility for a funded place is not guaranteed until Complete Training has completed the required checks and confirmed the Learner’s place.

Learners and, where applicable, Employers must provide accurate, complete and current information and evidence reasonably required to establish and maintain eligibility. This may include evidence relating to identity, age, residency, employment status, employer details, prior learning, qualifications, training history and any other information required by the relevant programme.

Where information or evidence is incomplete, inaccurate or cannot be verified, Complete Training may delay enrolment, pause participation or be unable to claim funding until the matter has been resolved.

Learners and Employers must promptly notify Complete Training if information relevant to eligibility changes during the programme.

21.2 Attendance, participation and completion

A funded place represents a commitment to participate in and make reasonable efforts to complete the programme. Learners are expected to attend scheduled teaching, participate in required learning activities, complete independent learning and assessments, and provide evidence required by the programme.

Complete Training may be required to monitor and report attendance, participation, progress and completion. Where a Learner repeatedly fails to attend or engage without an appropriate reason, Complete Training may contact the Learner to discuss their participation and may, where required by the funding or commissioning rules, withdraw the Learner from the programme.

Absence, withdrawal or non-completion does not automatically entitle the Learner to transfer the funded place to another programme or defer it to a later cohort.

21.3 Progression and outcome requirements

Skills Bootcamps are intended to support progression in employment, skills or career opportunities. Depending on the applicable programme, Learners may be required to participate in progression activity, which may include an interview, employment opportunity, career development discussion or another programme outcome.

Learners must provide reasonable information and evidence requested by Complete Training following completion of the programme where this is necessary to demonstrate progression or another funded outcome. This may include information relating to employment, interviews, new responsibilities, progression, promotion or other outcomes recognised by the applicable programme.

This obligation may continue after teaching has ended for the period required by the relevant funding or commissioning arrangements.

Complete Training does not guarantee employment, promotion, an interview outcome, increased earnings or another particular progression outcome.

21.4 Employer responsibilities and contributions

Where an Employer is participating in a Skills Bootcamp or other Funded Programme, the Employer must provide accurate information and evidence reasonably required for enrolment, eligibility, funding, participation and outcome reporting.

Where an employer contribution is required, the Employer is responsible for paying the contribution specified in the applicable programme agreement or invoice. The amount or percentage of employer contribution will be determined by the funding rules applicable to the relevant programme at the time.

Employers must cooperate with reasonable requests for information required to evidence employment, participation, progression or programme outcomes.

21.5 Funding and changes to programme rules

Public funding is subject to rules and decisions outside Complete Training’s control. Funding Bodies, government departments, commissioners and Contracting Authorities may amend eligibility requirements, evidence requirements, funding rates, employer contributions, programme outcomes, reporting requirements or other conditions.

Complete Training may make reasonable changes to the administration or delivery of a Funded Programme where necessary to comply with a change in funding or commissioning requirements. Where a change materially affects a Learner or Employer, Complete Training will provide reasonable information about the change where practicable.

No Learner or Employer will automatically become personally liable for public funding that Complete Training is unable to claim solely because funding has been withheld or refused. Any employer contribution, Learner charge or recovery of costs must be permitted by the applicable funding rules and contractual arrangements.

21.6 Accuracy, fraud and funding assurance

Learners and Employers must not knowingly provide false, misleading or inaccurate information relating to eligibility, identity, residency, employment, attendance, participation, completion, progression or programme outcomes.

Learners, Employers and Group Leaders must not ask Complete Training or its staff to create, alter or approve information that Complete Training knows to be inaccurate.

Where Complete Training reasonably believes that information or evidence may be inaccurate, fraudulent or otherwise inconsistent with the applicable funding requirements, it may pause enrolment, participation, certification or a funding claim while the matter is reviewed.

Complete Training may be required to correct information or report relevant matters to the Funding Body, commissioner, Contracting Authority, Awarding Body or another appropriate organisation.

21.7 Information sharing and reporting

Complete Training may be required to collect, retain and share relevant information with the organisation commissioning or funding the programme and other organisations involved in its administration, assurance, evaluation or audit. This may include information relating to eligibility, attendance, participation, completion, employment and progression outcomes.

Information will only be processed and shared where there is an appropriate lawful basis and in accordance with applicable data protection requirements and Complete Training’s Privacy Notice.

21.8 Programme-specific requirements

A particular Skills Bootcamp or Funded Programme may have additional requirements set out in a Learner Agreement, Employer Agreement, programme specification, funding agreement or other programme documentation. Where those requirements are mandatory conditions of the funding or commissioning arrangement, they will apply to that programme alongside these Terms.

22. Employer sponsored and organisational training

Where an Employer, organisation or Sponsor purchases or funds training, the Client remains responsible for the fees and obligations allocated to it under the booking or agreement.

A sponsoring organisation does not automatically gain access to all information about a Learner. Complete Training may provide appropriate information about attendance, participation, progress or completion where there is a lawful basis and the Learner has been given relevant privacy information.

Employers must not require Complete Training to alter assessment outcomes, Awarding Body requirements or professional academic decisions.

Where employer co-funding applies to a Funded Programme, the Employer must pay the contribution stated in the applicable programme agreement or invoice.

Information about reasonable adjustments, safeguarding or other confidential matters will not automatically be disclosed to an Employer merely because the Employer paid for the Course. CT will share information only where there is an appropriate lawful basis or another legal or safeguarding requirement.

23. One to one tuition and individually booked sessions

Where Complete Training provides one to one tuition or another individually booked live session, the booking confirmation will state the date, duration, delivery method and any specific objectives or preparation requirements.

A Learner who arrives or joins late is not automatically entitled to extend the booked finish time. Where Complete Training agrees to extend or rearrange a session, additional charges may apply.

Cancellation, non-attendance and rescheduling arrangements for one-to-one tuition may be stated at booking or in a service specific agreement. Any such conditions remain subject to statutory consumer rights where applicable.

One to one tuition supports learning but does not guarantee a particular assessment, qualification or progression outcome.

24. Bespoke, business and commissioned training

For bespoke or commissioned training, the quotation or service agreement may specify content, delivery dates, learner numbers, venue, equipment, travel, accommodation and other requirements.

The Client is responsible for providing agreed facilities, access, technology and a suitable learning environment where training is delivered at the Client’s premises.

Material changes to the brief, learner numbers, location, dates or delivery requirements may require a revised fee or timetable.

Unless expressly agreed otherwise, bespoke development and Course Materials remain Complete Training intellectual property. The Client receives the usage rights stated in the quotation or agreement.

Cancellation or rescheduling arrangements for substantial bespoke or commissioned programmes may be set out in the relevant quotation or service agreement.

25. Sponsored and discretionary funded places

Where Complete Training offers a sponsored, bursary or discretionary funded place, eligibility and any special conditions will be stated in the relevant scheme information or separate agreement.

A sponsored place has no cash value and cannot normally be transferred, resold or exchanged. Complete Training may withdraw an offer where eligibility information is materially inaccurate or scheme conditions are not met.

Nothing in this section affects statutory rights or any separate obligations imposed by an external funder.

26. Data protection and privacy

Complete Training processes personal information in accordance with applicable UK data protection law and its Privacy Notice. Complete Training is registered with the Information Commissioner’s Office under registration number ZA536922.

Depending on the Course, Complete Training may process information relating to identity, contact details, learning, assessment, accessibility requirements, funding eligibility and employment or progression outcomes.

Where a Client provides personal information about Learners, the Client must ensure it has an appropriate lawful basis to provide that information and has given any information it is required to give.

Where Complete Training acts as a processor on behalf of a Client, the parties will put in place the data processing terms required by applicable law where necessary.

27. Course cancellation or rescheduling by Complete Training

Complete Training may cancel, postpone, combine or reschedule a Course where reasonably necessary, including because of insufficient enrolment, teacher absence, venue problems, Awarding Body changes, funding changes, safety concerns or circumstances outside our reasonable control.

Where Complete Training cancels a paid Course and cannot offer a reasonable alternative, the Client will be offered an appropriate refund for the affected training. Where a Course is rescheduled, Complete Training will provide reasonable notice where practicable and consider the circumstances of Learners who cannot attend the revised date.

Complete Training is not responsible for consequential costs that were not reasonably foreseeable or were not caused by a breach by Complete Training, subject always to rights that cannot lawfully be excluded.

28. Promotions, discounts, free courses and tasters

Discounts, promotional codes, sponsored access and special offers may have separate eligibility, expiry and usage conditions. Unless Complete Training expressly states otherwise, discounts and promotional offers cannot be combined.

Complete Training may correct an obvious pricing or description error before accepting an order. If an order has already been accepted at an obvious erroneous price, Complete Training will contact the Client and provide appropriate options in accordance with applicable law.

Free Courses, taster sessions, promotional access and complimentary places remain subject to the relevant conduct, intellectual property, recording, platform, safeguarding and data protection provisions of these Terms even where no Course fee is payable.

29. Suspension and termination

Complete Training may suspend or terminate access where there is serious or repeated breach of these Terms, non-payment, misuse of Course Materials, academic misconduct, safeguarding concerns, abusive conduct, fraudulent information or another material reason.

Where appropriate, Complete Training will normally seek to explain the concern and provide a reasonable opportunity to resolve it before termination. Immediate action may be taken where necessary for safety, safeguarding, fraud, serious misconduct or protection of Complete Training systems or intellectual property.

Termination does not remove liability for sums properly due before termination and does not affect rights that have already arisen.

30. Liability

Complete Training will provide its services with reasonable care and skill.

Complete Training maintains appropriate insurance for its business activities, including employers’ liability, public liability and professional indemnity insurance where applicable to the training or Services provided. Evidence of relevant insurance may be provided to a Client, employer, commissioner, Funding Body or other contracting organisation on reasonable request. Where a commissioned training programme, contract or Funding Body requires a particular type or level of insurance, the applicable contractual requirements will apply.

Completion of a Course or training with Complete Training does not guarantee a particular assessment result, admission or progression to a further course, university or other education provider, professional registration, Access to Work or other funding, promotion, employment, a particular salary or eligibility for a particular role.

Subject to the paragraph above, Complete Training is not responsible for losses that were not reasonably foreseeable when the contract was made or that arise from circumstances outside Complete Training’s reasonable control.

For business Clients, and to the fullest extent permitted by law, Complete Training will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of anticipated savings. Complete Training’s aggregate liability arising from the relevant Course or service will normally be limited to the fees paid or payable for that Course or service, except where such a limitation would be unlawful or unreasonable.

Nothing in these Terms guarantees employment, promotion, funding, professional registration or a particular assessment result following completion of training.

31. Force majeure

Neither party will be responsible for failure or delay caused by circumstances beyond its reasonable control, including severe weather, transport disruption, fire, flood, epidemic or pandemic, industrial action, utility or internet failure, government action, venue closure or significant technology failure.

The affected party should take reasonable steps to reduce disruption. Complete Training may provide an alternative date, delivery method or reasonable extension where appropriate.

32. Group companies and referrals

Complete Training is part of The Inclusivity Group. Other group companies may provide communication, access, support or related services.

Where Complete Training introduces or refers a Client or Learner to another group company, services supplied by that company are subject to that company’s own contractual arrangements unless expressly agreed otherwise. Complete Training does not become the supplier of another group company’s services merely because a referral has been made.

33. Notices and communication

Routine communications may be sent by email, through the learning platform or through another contact method agreed with the Learner or Client.

Clients and Learners are responsible for keeping contact details up to date and checking communications relating to their Course.

Formal notices under a separately signed contract should be given using the method and address stated in that contract where it specifies a different notice procedure.

34. Changes to these Terms

Complete Training may update these Terms for future purchases. The version applicable to an existing contract will normally be the version accepted when that contract was formed, unless a change is required by law, an Awarding Body, a funder or regulator and can lawfully apply to the existing arrangement.

Material contractual changes will not be imposed retrospectively merely by publishing a new version on the website.

35. General

If Complete Training chooses not to enforce a provision on one occasion, that does not waive its right to enforce it later.

If any provision is found invalid or unenforceable, the remaining provisions continue in effect.

A Learner or Client may not transfer their contractual rights or obligations except as permitted by these Terms or with Complete Training’s written agreement. Complete Training may subcontract aspects of delivery while remaining responsible for its contractual obligations.

These Terms, together with the applicable Course information and any expressly incorporated written agreement, form the agreement between the parties in relation to the relevant training.

36. Governing law and jurisdiction

These Terms are governed by the law of England and Wales. Where the Client is a consumer, nothing in this clause removes any mandatory rights the consumer has to bring proceedings in another court where applicable law provides that right.

  1. Conflict of Interest

Complete Training (Devon) Ltd is committed to maintaining fairness, impartiality, integrity and transparency across all teaching, assessment, examination, quality assurance and administrative activities.

Due to the nature of our work and the communities in which we operate, members of our teaching and office teams may occasionally know, or have an existing relationship with, a learner who enrols on one of our courses or qualifications. This may include friends, family members, colleagues, former colleagues or other individuals with whom there is a personal or professional relationship.

An existing relationship with a learner does not automatically prevent a member of the team from being involved in their training. However, any actual, potential or perceived conflict of interest must be declared as soon as it is identified. Appropriate measures will then be considered and implemented to protect the integrity of the learner’s teaching, assessment and qualification.
